The United States Court of Appeals for the Third Circuit, agreeing with the Bankruptcy Court, has held that the Trump Taj Mahal has the right to modify the terms and conditions of employment for its employees from those imposed by an expired collective-bargaining agreement. The Bankruptcy Court found that the modifications are necessary for the debtor to remain in business, and that without the modifications all employees would therefore lose their jobs.
