On December 10, 2018, the U.S. Court of Appeals for the Third Circuit ruled for Robbins Russell client Zhi Fei Liao. The federal government seeks to deport Mr. Liao. It had been cleared to do so by two agency tribunals. The court of appeals appointed Robbins Russell associate Joshua S. Bolian to represent Mr. Liao pro bono. Mr. Bolian persuaded the court, through briefing and argument, that the government and the two tribunals were incorrect. The unanimous panel accepted Robbins Russell’s arguments in all respects. It held that the federal law listing deportable crimes did not encompass the state law under which Mr. Liao had been convicted. The court thus halted the deportation.
